CONTEST RULES AND IMPORTANT DISCLOSURE ITEMS
ELIGIBILITY: This Contest is open only to those who are 21 years or older as of the date of entry. The Contest is only open to legal residents of the United States. Names, addresses, email address, phone numbers and submission of a video or link to a video (the “Video”) as well as check a box stating they understand the Contest rules.

Employees of the 1824 HOUSE INN AND BARN LLC (the “Sponsor”), its affiliates, advertising agencies, and vendors (referred to as “Employees”), and their immediate family members together with those living in the same household, are not eligible to participate in the Contest.

The Contest is subject to all applicable federal, state, and local laws and regulations.

THE CONTEST IS VOID WHERE PROHIBITED BY LAW.

THE PRIZE: One Prize Winner will receive the following: (2) 2 nights accommodation for up to 16 people at 1824 House Inn + Barn on the nights of December 2nd and 3rd 2022, A 3-hour “Intimate Wedding Weekend Package” to be held December 3, 2022, at 1824 House Inn + Barn.

Intimate Wedding Weekend Package” includes: 3 hour reception in the barn at 1824 House Inn + Barn; Private wedding ceremony on the property of 1824 House Inn and Barn officiated by Greg Trulson, Justice of the Peace; Catered dinner for up to 16 people provided by 1824 House Inn + Barn; (4) four specialty gift bags provided by Mad River Taste Place; (2) table top flower arrangements, bridal bouquet and boutonniere provided by School House Garden; (3) hours of DJ services provided by Premier Entertainment;  (1) one wedding cake provided by Goose Chase Cake Design; ceremony and reception photos provided by Barrie Fisher Photography; custom cocktail designed by Mad River Distillers (alcohol not included)

Marriage license, taxes, gratuities and alcohol are not included. If the Contest winner wants to make arrangements for beer, wine or other alcoholic beverages at the wedding, they must make separate arrangements with the 1824 House.

SUBMISSION DATES: All videos must be received by 12 p.m. eastern standard time on March 31st.

CONTEST JUDGING & JUDGING CRITERIA: Judging will be conducted by a panel, and judges will score eligible videos using the following criteria:

(a) Technical Quality;
(b) Originality;
(c) Artistic Merit;
(d) Promotes the Mad River Valley as a vacation destination.

In the event of a tie for the Prize, the judges will use the artistic merit score of each tied submission to rank the videos. The decisions of the judges and the Sponsor will be final. Winners will be contacted and confirmed by email and/or telephone.

AGREEMENT TO RULES: By participating in the Contest, the Contestant (“You”) agree to be bound by these Rules. The decisions of Sponsor and the judges shall be final and binding on all matters pertaining to the Contest.    All Contest submissions, including the original Video and related artwork, become the property of Sponsor and will not be returned.  All pertinent federal laws and laws of the State of Vermont shall apply. 

REPRESENTATIONS AND WARRANTIES: You represent and warrant that You meet the eligibility requirements. By submitting a Contest submission, You represent and warrant that: (a) You have the legal capacity to enter the Contest;  (b) the Video and all of the content material contained in the Video are original and have been legally created by You and by no other persons; (c) You own all of the rights and title to the Video;  (d)  the Video does not infringe the intellectual property, privacy or publicity rights, or any other legal or moral rights of any third party; (e) the Video has not entered in or won previous contests or awards; (f) You have obtained permission from each person whose name, likeness or image is included in the Video, and that each such person has granted You all necessary rights to use the person’s name, likeness and image as described in these Rules, and that You can and will make written copies of such permissions available upon request.  If the name of a minor is included in the Video, such grant of rights must include written permission from the minor’s parent or legal guardian authorizing the use of the minor’s name, likeness and image on behalf of the minor.  

INDEMNIFICATION: You further agree to indemnify and hold harmless Sponsor and its officers, directors, owners, employees, agents and representatives from any and all claims, damages, expenses, costs (including, without limitation, attorneys’ fees) and liabilities (including, without limitation, settlements) brought or asserted by any third party against any of them due to or arising out of your Video, or your conduct in creating the Video, or any advertising or products subsequently produced, presented, and/or prepared by or on behalf of Sponsor using the Video or other actions in connection with the Video, including, but not limited to, claims for trademark infringement, copyright infringement, violation of an individual’s right of publicity or right of privacy, false advertising or defamation. You agree to be bound by the terms of use of each of Instagram, Facebook, Meta Platforms, Inc., and affiliated companies and release each such company of responsibility for your submission and posting of a Video and related artwork.

ASSIGNMENT OF RIGHTS: By accepting a Contest Prize, the Contest winner unconditionally assigns and transfers to Sponsor all rights, title and interest including, without limitation, copyright and other intellectual property interests, in whole and in part, which he/she now has or may in the future have to the submitted Video and related Video and related artwork and/or any element(s) therein including, without limitation, its use for advertising, publicity, promotion, or in commerce and in any and all media worldwide without limitation and without additional payment or consideration to any person or entity.   Furthermore, each Contest Winner agrees that each of his/her Video and related artwork will be deemed a Work Made For Hire under Copyright laws of the United States, but if it cannot be so deemed, then the Contest Winner irrevocably assigns and transfers to Sponsor all of his/her right, title and interest in and to his/her Video and related artwork, including but not limited to, all copyright and trademark rights which he/she may have, in the United States and worldwide, therein, for valid consideration, the receipt and sufficiency of which are hereby acknowledged. 

By submitting a Contest submission, You irrevocably grant Sponsor and its affiliates, legal representatives, assigns, agents and licensees, the nonexclusive, royalty-free, perpetual, irrevocable, transferable, unconditional, unlimited and worldwide right and permission to reproduce, encode, store, copy, transmit, publish, post, broadcast, display, publicly perform, adapt, exhibit and/or otherwise use or reuse each Video and related artwork (in its original form or as edited/modified in any way by Sponsor in its sole discretion), as well as to use (or not use) it or any portion of it in any and all media without limitation, worldwide and throughout perpetuity, without additional compensation, notice to, or approval from the Entrant or any other party.  

The Sponsor shall have the right to edit, modify, publish, use, alter, assign, transfer or dispose of each Video and related artwork however it sees fit without approval of the entrant.
  
PUBLICITY RIGHTS.   Each Entrant who submits a Contest Submission agrees to allow Sponsor and/or Sponsor’s designee the perpetual right to use his/her name, photos and/or likeness, and statements for promotion, trade, commercial, advertising, and publicity purposes, at any time or times, in all media now known or hereafter discovered, worldwide, without notice, review or approval and without additional compensation except where prohibited by law.

You agree to accept the decisions of 1824 House as final and binding as it relates to the content and rules of the Contest.

NO PURCHASE NECESSARY: No purchase is necessary. You can enter the Contest without buying accommodations, or other products or services from the Sponsor or its affiliates.


ADDITIONAL LIMITATIONS: Prizes are non-transferable. No substitution or cash equivalent of prizes is permitted. The Sponsor and its officers, employees and their respective affiliates are not responsible for any typographical or other errors in the offer or administration of the Contest, including, but not limited to, errors in any printing or posting or these Rules, the selection and announcement of any winner, or the distribution of any prize.

TAXES: The winner is responsible for all taxes on prizes they win.  The winner will be required to complete and submit an IRS Form W-9 or the equivalent including a winner’s full Social Security Number for receipt of any prize valued at $600 or more.  Failure to submit a complete W-9 or equivalent will result in disqualification and forfeiture of the prize.

TERMINATION: The Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Contest should a virus, non-authorized human intervention, fraud, or other cause beyond the Sponsor’s control corrupt or affect the administration, security, fairness, or proper conduct of the Contest. In such case, the Sponsor may select the winner from all eligible entries received prior to and/or after (if appropriate) the action taken by the Sponsor. The Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Contest or violates these Terms & Conditions.
The Sponsor has the right to maintain the integrity of the Contest, to void votes for any reason, including, but not limited to: multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by Contest rules; or the use of bots, macros, scripts, or other technical means for entering. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Contest may be a violation of criminal and civil laws.
 
LIMITATION OF LIABILITY: By entering, You agree to release and hold harmless the Sponsor and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) such entrant’s participation in the Contest and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Promotion; (v) electronic or human error in the administration of the Contest or the processing of entries.

DISPUTES: THE CONTEST IS GOVERNED BY THE LAWS OF THE UNITED STATES AND VERMONT, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Contest, participant agrees that any and all disputes that cannot be resolved between the parties and causes of action arising out of or connected with this Contest, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Vermont having jurisdiction. Further, in any such dispute, under no circumstances shall participant be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than participant’s actual out-of-pocket expenses (i.e. costs associated with entering this Contest). Participant further waives all rights to have damages multiplied or increased.

SPONSOR: 1824 HOUSE INN AND BARN LLC, with an address of 2150 Main St, Waitsfield, VT, 05673, is the sponsor of this Contest.
